BotJinn ("the Service", "we", "us", "our") provides an automated trading bot infrastructure for use on the Polymarket prediction markets platform. The Service allows users to deploy pre-configured algorithmic trading strategies that interact with the Polymarket CLOB (Central Limit Order Book) on their behalf.

BotJinn is a technology service provider only. We supply software tools, hosting, and automation infrastructure. We do not act as a broker, financial advisor, investment manager, exchange, or custodian. We do not hold, control, or have access to your Polymarket funds - all positions and transactions are executed directly through your own Polymarket wallet using credentials you supply.

The Service operates on a strategy-as-a-service model. Available trading strategies ("Blueprints") are configured by the platform administrator and made available for users to activate. Users run strategies entirely at their own discretion and risk.

The name Polymarket, its logo, and all related trademarks and intellectual property are the exclusive property of Polymarket Inc. and its respective owners. Their use on this platform is solely for descriptive, referential purposes - to identify the trading platform with which our software interfaces - and does not imply any association, approval, or endorsement.

Specifically, BotJinn:

• Has no formal relationship with Polymarket Inc. and has not been authorised, certified, or approved by Polymarket in any capacity.
• Is not an official product of Polymarket and is not affiliated with any official Polymarket application, service, or programme.
• Receives no sponsorship, funding, or compensation from Polymarket or any of its subsidiaries.
• Interacts with Polymarket's platform solely through publicly available APIs under your own account credentials and subject to Polymarket's own terms of service.

Any questions, issues, or disputes relating to Polymarket's platform, account policies, market resolution, or funds must be directed to Polymarket directly. BotJinn has no ability to intervene in or influence Polymarket operations, account decisions, or market outcomes.

Users are solely responsible for ensuring their use of BotJinn complies with Polymarket's current terms of service, acceptable use policies, and any applicable API usage restrictions.

To use BotJinn you must:

• Be at least 18 years of age, or the legal age of majority in your jurisdiction, whichever is greater.
• Have a valid, active Polymarket account and CLOB API credentials.
• Not be a resident of, or located in, any jurisdiction where participation in prediction markets or automated trading is prohibited by applicable law.
• Have the legal capacity to enter into a binding agreement.

By creating an account and using the Service, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to verify eligibility and to deny or revoke access at our sole discretion if we have reasonable grounds to believe eligibility requirements are not met.

All trading strategies made available through BotJinn are algorithmic software configurations. They are automated rule-sets that execute orders based on predefined parameters. They are not personalised recommendations, and their deployment does not imply any endorsement of their suitability for your individual financial situation, risk tolerance, or investment objectives.

Any performance data, win rates, return figures, or strategy descriptions displayed on this platform are provided for informational purposes only and do not constitute a promise, projection, or guarantee of any future performance. Historical or hypothetical performance data does not reflect actual results and may not account for market conditions, liquidity, latency, fees, or other factors that would affect real trading outcomes.

Prediction market trading carries significant risk of loss. You should consult a qualified financial professional before committing any funds to automated trading. BotJinn assumes no liability for any decisions made based on information, tooling, or strategies provided through the Service.

By activating any strategy, you confirm that you understand how it operates, that you accept its risks, and that you are making an informed, independent decision to use it.

Trading on prediction markets involves substantial risk of loss. Market conditions, liquidity, event resolution, API availability, network latency, and many other factors can adversely affect trading outcomes. Automated strategies may behave unexpectedly in conditions they were not designed for.

Any historical results, strategy statistics, or win-rate figures shown on this platform do not guarantee that the same or similar results will be achieved in the future. Past performance — whether real, simulated, or hypothetical — is presented solely for informational purposes and must not be construed as a prediction of future performance.

Specifically, BotJinn provides no warranty or representation that:

• Any strategy will be profitable or will achieve any particular return.
• Any strategy described as having worked in the past will continue to work in the future.
• The bot will execute trades as intended or at the intended prices.
• The Service will maintain uptime, availability, or continuous operation.
• Strategy parameters will remain optimal under changing market conditions.
• Any implied warranty of merchantability or fitness for a particular purpose.

Market conditions on Polymarket change constantly. Strategies that performed well under previous conditions may perform poorly or generate losses under different conditions. You are solely responsible for understanding and accepting these risks before deploying any capital.

You use all strategies and the Service entirely at your own risk.

By accessing the Service you acknowledge and agree that:

• No refunds will be issued for any reason, including but not limited to: dissatisfaction with results, strategy underperformance, service interruptions, account termination, or early cancellation.
• Any trading losses incurred while using the Service are your sole responsibility and will not be reimbursed by BotJinn under any circumstances.
• Fees paid cover access to the platform infrastructure and tooling only - they do not represent a guarantee of any trading activity, profit, or outcome.
• Chargebacks or payment disputes initiated against BotJinn may result in immediate and permanent account termination.

You are solely responsible for:

• Account security: Keeping your BotJinn login credentials, Polymarket API keys, private keys, and CLOB passphrase secure and confidential. You must immediately notify us if you suspect unauthorised access to your account.
• Credential accuracy: Ensuring that all API credentials you supply are valid, current, and have appropriate permissions. Invalid credentials will prevent the bot from operating, and we accept no liability for resulting missed trades or losses.
• Strategy configuration: Understanding the parameters of any strategy you activate before deploying it with real funds. You acknowledge that activating a strategy constitutes your informed consent to its operation.
• Fund management: Maintaining sufficient funds in your Polymarket wallet for intended trading activity. BotJinn has no visibility into or control over your wallet balance.
• Legal compliance: Ensuring your use of the Service and of Polymarket complies with all applicable laws and regulations in your jurisdiction, including tax obligations arising from trading activity.
• Polymarket Terms: Complying with Polymarket's own terms of service. BotJinn is a third-party tool and any violation of Polymarket's terms is entirely your responsibility.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right.
• Engage in market manipulation, wash trading, spoofing, or any other form of fraudulent or deceptive trading practice.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive source code from the BotJinn platform.
• Access or attempt to access other users' accounts, data, or credentials.
• Introduce malicious code, viruses, or harmful software into the Service.
• Circumvent or attempt to circumvent any security, authentication, or rate-limiting mechanisms.
• Resell, sublicense, or provide access to the Service to third parties without our express written consent.
• Use the Service in a manner that places an unreasonable or disproportionate load on our infrastructure.

Violation of any prohibited use provision may result in immediate account suspension or termination without notice and without refund.

Reasons for termination may include, but are not limited to:

• Breach of any provision of these Terms of Service.
• Fraudulent, abusive, or disruptive behaviour.
• Non-payment of applicable fees.
• Extended periods of inactivity.
• Our decision to discontinue the Service, in whole or in part.
• Legal, regulatory, or compliance requirements.
• Any reason we deem necessary to protect the platform, other users, or our business interests.

Upon termination, your right to access the Service ceases immediately. Any active bot sessions will be stopped. We are under no obligation to retain your configuration data or provide it to you upon termination, though we may do so at our discretion.

Termination does not entitle you to any refund of fees paid. Provisions of these Terms that by their nature should survive termination shall do so, including Sections 5, 6, 10, and 11.

This limitation applies to all claims, whether based on warranty, contract, tort, statute, or any other legal theory, and regardless of whether we have been advised of the possibility of such damages. Specifically, we shall not be liable for:

• Trading losses of any amount, regardless of cause.
• Loss of profits, revenue, data, or business opportunity.
• Losses arising from service outages, downtime, bugs, or errors in the platform or strategy logic.
• Losses arising from API failures or disruptions on Polymarket's end.
• Losses arising from unauthorised access to your account due to your failure to maintain credential security.
• Any consequential or incidental damages resulting from market movements during periods of bot downtime.

Where liability cannot be fully excluded by law, our total aggregate liability to you for all claims shall not exceed the total fees paid by you to BotJinn in the thirty (30) days immediately preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless BotJinn and its operators, employees, contractors, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use or misuse of the Service.
• Your violation of these Terms of Service.
• Your violation of any applicable law or third-party right.
• Any trading activity conducted through your account.
• Any inaccurate or incomplete information you provided during account setup.

We reserve the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate with our defence of such claim at your expense.

All software, designs, algorithms, strategy logic, user interface elements, trademarks, and other materials comprising the BotJinn platform are the exclusive intellectual property of BotJinn and its operators, protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your personal, non-commercial trading purposes during the term of your subscription. This licence does not include any right to:

• Copy, reproduce, or distribute any part of the platform.
• Modify, adapt, or create derivative works.
• Use any BotJinn trademarks, logos, or branding without express written permission.
• Scrape, data-mine, or systematically extract information from the platform.

We collect and store only the minimum data necessary to operate the Service, including your account credentials, Polymarket API keys (encrypted at rest using industry-standard encryption), bot configuration, and trading state data.

Your Polymarket private key and API credentials are encrypted using a server-side secret before storage and are never logged, transmitted to third parties, or accessible in plaintext to BotJinn staff under normal operating conditions.

We do not sell, rent, or share your personal data with third parties for marketing purposes. We may disclose information if required by law, regulation, or valid legal process.

By using the Service, you consent to the collection and use of data as described above. You may request deletion of your account data at any time by contacting us, subject to any legal retention obligations.

Amendments: We reserve the right to modify these Terms of Service at any time. Significant changes will be communicated via a notice on the platform. Continued use of the Service after any amendment constitutes your acceptance of the revised terms. It is your responsibility to review these Terms periodically.

Entire Agreement: These Terms of Service constitute the entire agreement between you and BotJinn regarding the Service and supersede all prior agreements, understandings, or representations relating to the same subject matter.

Severability: If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Governing Law: These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or courts of competent jurisdiction.
